I think that article is a little misleading, he says you can tune without fear? Don't think that's true at all and Harley themselves settled a big lawsuit and fine from the DOJ due to illegal tunes.

Here's the statement from the FTC and it seems to talk about repairs more than anything else and that's a lot different from tunes and mods.

FCA lost a lawsuit against hp tuners for cracking pcm and tuning under right to repair - because even though they own the software, the owner owns the calibration, which is covered under right to repair (at least used to be)
