That sounds suspect. OEMs have to put a speed limiter to match the tires speed rating. There are no separate speed ratings for "racing" on tires.

My guess is the car's limiter is higher (and 168 like the tires are rated) and this is just a "at your own risk clause".

The way I read is it will exceed 149mph in drag mode and you should never exceed 149 in street mode.

What it actually means is you can use the tires to their rated top speed regardless of vehicle drive mode or road surface. They just don't want you to blame them if anything happens.

I emailed Dodge Garage and that is exactly what they told me, that the car can exceed 149 mph only when in drag mode
